Statutory Discrepancies and Diluted Standards

The core legal dispute centres on a contradiction between administrative instruments: an environment ministry memorandum bans raw industrial effluent transport via vehicular tankers and mandates fixed pipelines, yet a conflicting notification actively regulates tanker haulage. Environmental legal counsel Sanjaya Kumar Mishra told the tribunal these instruments are irreconcilable, arguing that stricter directives need enforceable statutory backing. Furthermore, companies frequently secure clearance amendments to route partially treated chemical water into agriculture or landscaping, undermining zero liquid discharge mandates. Evidence from a Supreme Court review indicates severe contamination puts over two million lives at risk from groundwater toxicity.

Surveillance and Enforcement Actions

Led by Chairperson Justice Prakash Shrivastava and expert member Dr Afroz Ahmad, the tribunal directed the environment ministry to address non-compliance and consider a national online portal for reporting environmental crimes. Additionally, the Central Pollution Control Board was instructed to fast-track action against over 1,700 grossly polluting industries along critical river basins, requiring automated continuous monitoring and flow meters.
