We Asked: Do you think more lenient laws are needed to ensure wildlife conservation? For example, if someone helps a crane or a goose or a wild rabbit or deer and that gets attached to him and starts visiting him, the person should not be penalized or prosecuted nor should the two be separated. Should a more healthy and let live policy be allowed in areas fringing forests and wetlands?

My personal opinion on the basis of around 15 years of experience with wildlife rescue, treatment, rehabilitation and conservation where I have interacted with thousands of different species right from leopards to squirrel, eagle to flamingo and turtle to snake,  would be ‘No’. Wildlife conservation is more than just emotions and more about the science of what actually is required for the betterment of wildlife than what we think and assume. Wildlife conservation is never about one individual specie but more about the whole species. Humans and wildlife have been closely related to each other since the birth of mankind. It is very important to understand that an individual of a species may behave unlike other individuals in certain cases however that does not mean that conservation action is generalised with one specific case while working towards a larger picture. When humans try to get involved with wildlife by getting too close to them, although with the purest intent, we many times do more bad than good. To conserve wildlife, we need to save their habitat more than trying to take care of them by feeding them or making shelters for them. Wild animals are created by nature to be independent and take care of them on their own; that is how nature is designed. The strongest will survive on its own and the ones who can’t will ensure others survival in different manner by being food or manure to fertile the land. Maintaining distance and allowing nature to take its own course is the fundamental of conservation followed by ensuring maximum intervention only when required and no interference. When we try to get close, feed or tame wild animals, we actually end up manipulating their natural instincts because of which their behaviour pattern changes, sometimes that may look good, which is not the case. They are meant to be independent and on their own for their survival. It is obvious that any animal in distress due to manmade reasons must be helped or rescued but real impact is only successful when it is set back to wild. Helping a wild animal is totally different than being attached to that animal. Maintaining distance is very essential for the animal as well as human. For example, if a tiger is rescued by a person from wild, it has to be rehabilitated and not made to get attached because once the animal is used to a human, it will also be attached. But it is not necessary that it will have that same attachment for all humans and there may be a conflict in future where a human other than the attached human may get injured by that tiger or any other human may hurt, hunt or poach that tiger who has started trusting humans. Same is the case with any other wildlife like a hare, a crane, a goose, a rhino, elephant or a parakeet. Although intentions may be pure but science is also a proved intention in which we must trust and believe. At the same time, the scene with captive wildlife has to be totally different as they can’t survive on their own and therefore must be taken care in a different manner in controlled environment like orphanages, rescue centers or zoos. However, this aspect is totally different than in wild. The current laws are decent enough and with time shall modify, however allowing people to be friends with wildlife will do more bad than good and this has been witnessed globally. Just like we do not collect water to generate rains, and they naturally happen on their own, ensuring that we do not waste available water, do less damage to the environment, focus on climate change which is real, we must allow wildlife to flourish on its own by ensuring that their habitat is protected. Nation builders have made good laws and policies which exist and with time they must be amended and modified, however the basic foundations and fundamentals must never be compromised. We can see how we have misused and exploited farm animals or captive domestics, then may it be dairy, poultry, fishing or slaughter. We raise them and we kill them to satisfy our needs and after a point they are more than basic need of survival for so many who can afford alternatives but we still witness large scale cruelty. Which mother cow will be happy to share the milk it has for its calf? Which chicken would be happy to see its friend or family member to get slaughtered in front? Similarly, after taming wildlife, it would go beyond control and exploitation will happen, just like tiger farms in China or other wildlife breeding centres. Therefore, the best is to preserve what we have and let nature take its own calls. -Adv. Pawan S. हाल ही में अमेठी के रहने वाली आरिफ और सारस की कहानी आप सभी ने सुनी होगी। अमेठी के एक गांव में रहने वाले आरिफ को एक सारस घायल अवस्था में मिला था जिसे उन्होंने अपने घर पर लाकर उसका उपचार व देखभाल किया। इस दौरान सारस और आरिफ के बीच दोस्ती हो गई जो इतनी प्रगाढ़ हुई की सारस ठीक होने के बाद भी आरिफ से रोज मिलने आने लगा। ऐसा अनेकों पशु प्रेमियों के साथ अक्सर होता रहता है जब वे किसी घायल या संकट में फंसे पशु-पक्षी की मदद करते हैं। आरिफ और सारस की दोस्ती कुछ दिनों में समाज में चर्चा का विषय बन गई और सोशल मीडिया के माध्यम से वो तेजी से फैलने लगी। इस खबर के वायरल होते ही विभिन्न लोग सारस व आरिफ से मिलने अमेठी पहुंचने लगे जिसमें विभिन्न राजनेता भी थे और फिर वहां सारस मीडिया के कैमरों से भी घिरा रहने लगा और देखते ही देखते वो दोस्ती एक तमाशे में बदल गई। इस तरह एक वन्यजीव का प्रदर्शन व उसे अप्राकृतिक भोजन लोगों के द्वारा खिलाया जाना वन्यजीव अधिनियम के उल्लंघन का विषय बनने लगा और उत्तर प्रदेश वन विभाग को इस मामले में दखल देकर उस सारस को अपनी अभिरक्षा में लेना पड़ा। वर्ष 1972 में बने वन्यजीव संरक्षण अधिनियम के अस्तित्व में आने से पूर्व बड़े पैमाने पर वन्यजीवों का शिकार मनोरंजन व भोजन के लिए किया जाता रहा था। समाज के एक बड़े हिस्से के लिए वन्यजीवों के शिकार को एक साधारण बात व अपना अधिकार माना जाता था। फिर जब वन्यजीव अधिनियम लागू हुआ तो वन विभाग के सामने एक बड़ी चुनौती लोगों के व्यवहार में परिवर्तन लाना था क्योंकि कोई प्रचलित कार्य अचानक यूं ही एक कानून के बनने से रुक नहीं जाता। इस कानून के अस्तित्व में आने के बावजूद वन्यजीवों का शिकार 1972 के बाद भी कई दशकों से चलता रहा जिसमें धीरे धीरे कमी आती रही। इस प्रकार वन विभाग ने कई दशकों के प्रयास के बाद लोगों में वन्यजीवों के प्रति विचार को बदलने में सफलता प्राप्त किया और आज लोग वन्यजीवों को पकड़ना, पालना, बेचना या शिकार करने को इसी कारण प्रकृति के संरक्षण में बाधक व एक अपराध की दृष्टि से देखते हैं चूंकि वन्यजीव संरक्षण अधिनियम, 1972 में किसी भी वन्यजीव को पकड़ना, मारना, पालना, उनके अंडे या पर्यावास को नष्ट करना कानूनन अपराध है और सिर्फ वन विभाग ही किसी वन्यजीव को किसी परिस्थिति में पकड़ने या अन्य कार्यों के लिए अधिकृत है। फिर भी देश में आज हजारों वन्यजीव रेस्क्यूअर हैं जो घायल या संकट में फंसे वन्यजीवों को रेस्क्यू करते हैं व कई बार उनका उपचार व देखभाल भी करते हैं और इन मामलों में अच्छी नियत के कारण वन अधिकारी ऐसे रेस्क्यूअर को इसकी अलिखित सहमति भी देते हैं और रेस्क्यू करने वाले लोग भी अपनी जिम्मेदारी से उस वन्यजीव का प्रदर्शन न करके उसको संकट से उबारकर उसके उचित पर्यावास में छोड़ देते हैं। परंतु आरिफ के मामले में उस सारस का प्रदर्शन होने लगा जिससे यह आशंका थी की अन्य लोग इससे ऐसे पक्षियों से दोस्ती करने के नाम पर उन्हें पकड़ेंगे या उनके जीवन में खलल डालेंगे जिससे वन विभाग की वर्षों की मेहनत बेकार हो जाएगी। चूंकि आज भी पक्षियों का व्यापार चोरी-छिपे होता रहता है और लोग पक्षियों से दोस्ती के नाम पर उन्हें कानून के विरुद्ध खरीदते हैं जिससे वन्यजीवों का भारी नुकसान होता रहता है। ऐसे में इस प्रकरण से प्रेरित होकर लोगों में इस अपराध को बढ़ाने की पूरी आशंका थी अतः वन विभाग को उस सारस को अपनी अभिरक्षा में लेकर कानून के अनुसार जनता को एक कड़ा संदेश देने के अतिरिक्त कोई चारा नहीं था। घायल वन्यजीवों की मदद के मामले में कुछ वैधानिक बदलाव की आवश्यकता भी है। चूंकि आज यदि हम देश को देखें तो कुछ क्षेत्रों को संरक्षित वन क्षेत्र व अन्य बड़े क्षेत्र को सामाजिक वानिकी में रखा जाता है। जो क्षेत्र संरक्षित वन्यक्षेत्र हैं वहां वनकर्मियों को वन्यजीवों के विषय में ट्रेनिंग व सुविधा प्राप्त होती है लेकिन सामाजिक वानिकी में वन विभाग का मुख्य कार्य पौधरोपण या पेड़ों की सुरक्षा होती है अतः वहां वनकर्मियों के पास घायल या संकट में पड़े वन्यजीवों के मदद के लिए कोई विशेष ट्रेनिंग या सुविधा के अभाव में वह कार्य अपनी रुचि के अनुसार वन्यजीवों के लिए कार्य करने वाले आमजनों को भी करना पड़ता है। चूंकि वन और वन्यजीव संरक्षण सिर्फ सरकार या विभाग का दायित्व नहीं है बल्कि यह आमजनों का भी संवैधानिक कर्तव्य है जिसे संविधान के अनुच्छेद 51।(ह) में बताया गया है अतः वन्यजीवों को रेस्क्यू करने वाले संस्थानों व लोगों को संकट में फंसे वन्यजीवों की मदद की कानूनी अनुमति देने के लिए जिलास्तरीय समितियां बनाई जानी चाहिए जिसमें जिले के जिलाधिकारी, जिला वनाधिकारी, विभिन्न रेंज के रेंजर व समाज में वन्यजीवों के संरक्षण के विषय में रुचि रखने वाले लोगों को रखा जाए जो किसी मुश्किल में फंसे वन्यजीवों को रेस्क्यू करने की अविलंब सशर्त अनुमति ऐसे रेस्क्यू करने में इच्छुक लोगों को देने का कार्य कर सकें। इससे न सिर्फ वन्यजीवों के संरक्षण को बढ़ावा मिलेगा बल्कि कानून का उल्लंघन भी नहीं होगा। साथ ही वन्यजीवों का रेस्क्यू करने वाले लोगों को भी यह बात ध्यान में रखने की आवश्यकता है कि वे किसी भी वन्यजीव को लेकर किसी प्रकार प्रदर्शन न करें, वे अपनी जिम्मेदारी समझें कि वन्यजीवों को उनके पर्यावास में रहने व प्राकृतिक भोजन की जरूरत है। इंसानों के साथ ऐसे प्राणियों की निकटता का मुख्य कारण आसानी से भोजन व सुरक्षा प्राप्त करना होता है लेकिन इससे उस वन्यजीव की प्रकृति खतरे में पड़ती है व उसकी क्षमताएं घटती हैं जिससे न सिर्फ उसे नुकसान होता है बल्कि वो उनकी प्रजाति के अस्तित्व को भी लंबे समय तक नुकसान पहुंचाता है। वन्यजीवों के संरक्षण का कार्य भावनात्मक ढंग से कम और वैज्ञानिक समझ के साथ करने की जरूरत है और वन्यजीव संरक्षण अधिनियम के प्राविधान बहुत सोच-समझ कर बनाए गए हैं जिसका पालन भी बड़ा आवश्यक है। रेस्क्यूअरों को अपने क्षेत्र के Calls to free the now-famous Uttar Pradesh sarus crane back in her natural home have only grown stronger after the chief conservator of forests in Kanpur said she would continue to be jailed in the Kanpur zoo despite being a wild bird. The distraught bird has not been eating properly since her incarceration, so her continued imprisonment puts her life at risk. Meanwhile, Mohammad Arif – the farmer from a village in Amethi district who had found the injured bird in a crop field and nursed her back to health – is, astonishingly, left fending off a case lodged against him under the Wild Life (Protection) Act, 1972, even though he protected wildlife, which is exactly what this law is for. The same Act that is being invoked to penalise Arif for his kindness also defines a zoo as a place where “captive animals” are kept and stipulates that these animals must come only from another zoo and not be captured in nature. Yet while Arif has presumably been booked for capturing the crane – which he never did, as the crane was free to go – state authorities have now indeed captured the bird and confined her to a zoo. The “Guidelines for Management of Zoos” states even when animals are rescued, ideally, “all seized wild animals should also be rehabilitated back in the wild”. This sarus crane was already in the wild and had been living well for a year after her wounds healed, flying in and out of Arif’s area and following him about by choice. Arif never caged the bird. So why a crane who flew across fields of her own free will would need to be “rescued” and put in a cell is beyond comprehension. According to the “Guidelines for Management of Zoos”, one purpose of a zoo is to “develop amongst visitors an empathy for wild animals and motivate them to support the cause of conservation of wildlife”. However, keeping a forlorn bird captive in a zoo, where she won’t eat, and prosecuting a good Samaritan hardly motivates people to help wild animals in distress. On the contrary, it dissuades them from doing so for fear of being punished. Wildlife experts say the right thing to do would have been for Uttar Pradesh forest officials to educate Arif about what to do if he comes across injured wildlife again (which is to call the forest department) and counsel him on how to stop sharing his food gradually with the crane and help her return to her natural ways. After all, where there is no criminal intent, the spirit of the law should be considered. Besides, the crane’s proximity to humans is not her fault. Human-animal conflict in some cases and coexistence in others are increasing in India as cities expand and swallow surrounding animal habitat. Expressways and railway lines are cutting through animals’ homes, while more and more buildings are being built where forests once stood. That’s why monkeys, both macaques and langurs, although considered wild animals, live in Indian cities – not because they want to but because we have taken over their homes. When they get electrocuted, as they often do, we humans nurse them back to health, which is our ethical duty. Peacocks are also seen strutting about on the lawns and roofs of private residences in parts of India. यह सत्य है कि पर्यावरण की समस्या जो कि आज इस दुनिया के सम्मुख है, इस ग्रह का भविष्य बदल देगी। हम में से कोई भी पद या संपत्ति  में कितना भी शक्तिशाली हो प्रभावित हुए बिना नहीं रह सकेगा। वैज्ञानिकों द्वारा अनेकों शोध करके इस पृथ्वी पर जलाशय में  नदी नालों समुद्रों में वास करने वाले 87 मिलियन (सत्तासी लाख)  जीवधारियों की गणना की है, इनमें से अभी तक 91 प्रतिशत जीवधारियों को कोई नाम नहीं दिया जा सकता है परंतु यह समस्त जीवधारी जीवन का एक आयाम है व एक दूसरे से किसी ना किसी रूप में जुड़े हुए हैं और सुचारू जीवन के बने रहने के लिए इनका अस्तित्व आवश्यक है। मानव क्योंकि सर्वोत्तम प्राणी है उसमें बुद्धि कौशल विचार सक्रिय है इसलिए यह उसका परम धर्म है कि जीवन को कायम रखने के लिए जीवन के समस्त आयामों को सुरक्षित रखा जाए व संरक्षण दिया जाए। यद्यपि अधिकांश मानव अज्ञानतावश स्वार्थवश जीवन के आयामों का सम्मान नहीं करते हैं और  वन्य मूल्यों को समाप्त करते हैं इसी कारण से पूरे विश्व में व भारत में नियम व कानून बनाए गए हैं जिससे वन्य प्राणियों को संरक्षण प्राप्त हुआ है। इस प्रकार भारत में 104  राष्ट्रीय उद्यान, 551 वन्य प्राणी विहार, 121 मरीन प्रोटेक्टेड एरिया, 78 वायु स्पेशल एरिया, 88 कंजर्वेशन रिजर्व व 127  कम्युनिटी रिजर्व विद्यमान है जिनके कारण कुछ वन्य प्राणी अभी भी शेष है। वन्य प्राणियों को पकड़ना, मारना उनके निवास स्थल को नष्ट करना दंडनीय अपराध है। आज मानवों की संख्या अत्यधिक बढ़ रही है व वन्य प्राणियों की संख्या चिंतनीय है, ऐसे में मानव वन्य प्राणी टकराव ना होने देना परम आवश्यक है। इस कार्य के लिए शिक्षित स्वयंसेवी सामाजिक कार्यकर्ताओं को आगे बढ़कर समाज में विशेषतया जंगलों के आसपास निवासियों को वन्य प्राणियों से मित्रवत व्यवहार करना, उनके प्रति दया धारणा का भाव उत्पन्न करना एवं जागरूकता लाए जाने का कार्य करना चाहिए। यदि वन्य प्राणी किसी आपदा में आ जाए तो उनको सुरक्षित अपने प्राकृतिक वास में जाने दिया जाए। प्रशासन को ऐसे व्यक्तियों व संस्थाओं को विशेष छूट देकर वन्य प्राणियों के हितों में कार्य करने वालों का सम्मान करना चाहिए। घायल वन्य प्राणियों को पशु चिकित्सक वरीयता के आधार पर इलाज मिले जाने हेतु आवेदित राशि मिल जानी चाहिए। मानव में वन्य प्राणियों के जीवन के प्रति उदारता, करुणा, दया की भावना जागृत किए जाने और सहयोग किए जाने से बेहतर परिणाम आना निश्चित है। नदीम अकबर हाशमी, एक्स फॉरेस्ट रेंजर
